According to Farm Sanctuary, North Carolina recently struck down a law designed to stop undercover investigations in the state. The so-called “Anti-Sunshine Law” allowed journalists and undercover investigators who exposed criminal or improper conduct susceptible to lawsuits and damages if they made their found evidence public.
The Anti-Sunshine Law was fought by animal rights groups who considered it an “ag-gag” law where agriculture companies and farms can hide unsafe practices and animal abuses, according to Farm Sanctuary. Animal groups, consumer rights advocates, food safety groups and whistleblower protection organizations all joined to file suit challenging the constitutionality of the law.
Farm Sanctuary shared the following in an email, In North Carolina, the plaintiffs’ challengers included groups: People for the Ethical Treatment of Animals, Center for Food Safety, the Animal Legal Defense Fund, Farm Sanctuary, Food & Water Watch, Government Accountability Project, Farm Forward, and the American Society for the Prevention of Cruelty to Animals.

The plaintiffs shared this emailed statement, “North Carolina’s Anti-Sunshine Law placed the safety of our families, our food supply, and animals at risk. It was an attempt to bully and threaten those working for transparency, free speech and the public good. We brought this lawsuit for the sake of the health and safety of all citizens of North Carolina, and are glad to see this law struck down today. State legislators elsewhere should take note: these types of laws are simply unconstitutional.”
