California’s AB 2344 Could Free Thousands of Abused Animals Stuck in Legal Limbo

When animals are rescued from cruelty and neglect, most people assume the hard part is over. But for countless dogs, cats, and other creatures across California, rescue is only the beginning of a long, painful wait. Under current state law, animals seized during abuse investigations must remain in shelter custody until their criminal cases conclude, which can take months or even years, especially when defendants simply stop showing up to court.

A new piece of California legislation is working to change that. Assembly Bill 2344, known as the Rehome Abused Animals Act and authored by San Francisco Assemblymember Matt Haney, would give animal control agencies and prosecutors a legal pathway to petition courts for custody transfers when defendants fail to appear for 30 consecutive days. That means a traumatized dog or cat would no longer have to wait indefinitely behind bars just because a legal case has stalled.

According to the Los Angeles County Department of Animal Care and Control, animals in cases where defendants failed to appear spent significantly longer confined in shelters than those in cases that moved through the courts on a normal timeline. That extended confinement carries real consequences. Prosecutors and animal welfare experts have pointed to a condition sometimes called kennel neurosis, in which prolonged shelter stress leads to anxiety, aggression, and repetitive behaviors that make animals harder to rehome and harder to heal.

The bill passed the California Assembly with unanimous Support and now heads to the state Senate Public Safety Committee, where it is expected to be heard on June 23. It is cosponsored by the Los Angeles County District Attorney’s Office and Social Compassion in Legislation, a leading animal welfare advocacy organization. Supporters across party lines see this as both a compassionate and practical solution, one that frees suffering animals, eases shelter overcrowding, and reduces the financial burden on taxpayers.

Every animal that has survived abuse deserves a safe place to heal. AB 2344 is a meaningful step toward making that promise real.
