The European Union’s top court has ruled that pets transported by air count as “baggage,” not passengers — a decision that’s sparking debate across Europe about how society values the animals we love. According to DW News, the Court of Justice of the European Union (CJEU) sided with airlines in a case involving a woman whose dog went missing at Buenos Aires Airport while being loaded onto an Iberia flight. The court said pets fall under the legal definition of baggage under the Montreal Convention, meaning compensation for their loss is capped like that of a lost suitcase.

The court did emphasize that animal welfare laws must still be respected during transport — but for many animal advocates, that’s not enough. To classify living beings as property in the same way as luggage highlights a deeper disconnect between legal systems and how people actually see their pets: as family, not freight. Losing a dog is an emotional trauma, not a minor inconvenience with a price tag.

This ruling also points to the broader question of how institutions balance safety, liability, and compassion in an increasingly complex travel industry. While airlines prioritize efficiency and risk management, animal welfare often becomes secondary. For an environment already under strain from aviation’s carbon footprint, the least we can do is ensure that animals caught in this system are treated with dignity and care.

As more people travel with their companion animals and adopt plant-based lifestyles grounded in empathy, society is rethinking what humane treatment really means. Laws need to evolve too — recognizing that living beings deserve rights and respect that go far beyond what “baggage” implies.
