Supreme Court Case Could End Legal Protections for Animals

In early January, the Supreme Court heard arguments in two pivotal cases that could redefine the regulatory landscape in the United States. At the heart of these cases lies the doctrine of Chevron deference, a cornerstone of administrative law for the past four decades. Chevron deference mandates that courts defer to federal agencies’ reasonable interpretations of ambiguous statutes, providing agencies with significant power in regulatory matters.

The cases, Loper Bright Enterprises v. Raimondo and Relentless, Inc. v. Department of Commerce, center on a National Marine Fisheries Service (NMFS) policy requiring Atlantic herring fishermen to pay for federal agency monitors aboard their vessels. The fishermen argue against this requirement, contesting the agency’s authority and highlighting the financial strain it imposes on their livelihoods. However, the implications extend beyond the fishing industry. These cases are backed by conservative legal organizations linked to the Koch Network, signaling broader interests in challenging regulatory authority. Overturning Chevron deference could allow corporations opposed to regulation across various sectors, including the meat and dairy industries.

Chevron deference plays a pivotal role in enabling government agencies to fill statutory gaps and respond to evolving challenges like Climate change. Without it, agencies may face heightened scrutiny and constrained regulations. This could jeopardize crucial protections for workers, consumers, animals, and the environment.

Animal welfare advocates, in particular, voice concerns about the potential impact of regulations benefiting farmed animals and endangered species. The USDA, EPA, and other agencies are in the process of finalizing regulations aimed at enhancing animal welfare standards and environmental protections. Overturning Chevron deference could undermine these efforts, leaving vulnerable populations at greater risk. Critics of Chevron deference argue that it tilts the balance of power towards unelected bureaucracies and undermines the separation of powers. However, proponents emphasize its role in facilitating informed, flexible regulation and sparing lawmakers from micromanaging complex policy decisions.

While the fate of Chevron deference remains uncertain, its potential reversal raises profound questions about the future of regulation in the United States. The Supreme Court’s decision, expected in late spring or early summer, could hurt animals.
