Virginia Data Center Tax Break Bill Pushes Clean Energy Shift

Virginia lawmakers are trying a new deal with the data center boom: keep a huge tax break, but only if the industry cleans up its power use.

According to Charles Paullin, the Virginia House of Delegates passed House Bill 897 to extend the state sales tax exemption for qualifying new and existing data centers. The catch is that companies would need to take real steps to move away from fossil fuels, match electricity demand with clean energy, and use power more efficiently.

That matters because Virginia is already the epicenter of US server farms, and the growth is not quiet. Local residents have raised concerns about nonstop noise, heavy water use for cooling, and rising electricity bills tied to grid upgrades. Even if you love the convenience of streaming and cloud tools, the costs are showing up in daily life.

The bill also targets backup power. It would push data centers to transition away from diesel generators and toward non carbon options like batteries. For new facilities after July 1, 2027, it would also block companies from leaning on their own fossil fueled power sources as primary electricity.

Still, this debate is happening while more gas plants are on the table. One example is a proposed 944 megawatt peaker plant in Chesterfield County. A report prepared for the Southern Environmental Law Center estimates the plant’s fine particle Pollution could contribute to 80 premature deaths in Virginia over its expected life.
