Tesla is facing a new lawsuit over alleged air Pollution violations at its Fremont, California factory. The Environmental Democracy Project, a nonprofit organization, has accused Tesla of repeatedly violating the Clean Air Act. The lawsuit, filed in federal court in San Francisco, claims that Tesla has emitted harmful pollutants into surrounding neighborhoods “hundreds of times” since January 2021.

This is not the first time Tesla’s environmental practices have come under scrutiny. In 2023, the Political Economy Research Institute at the University of Massachusetts ranked Tesla 89th on its Toxic 100 Air Polluters list. In 2022, the Environmental Protection Agency fined Tesla $275,000 for failing to properly track and minimize emissions from its painting operations at the Fremont plant.

Earlier this year, Tesla settled with 25 California counties over the handling of hazardous waste materials at its facilities. Meanwhile, in Germany, environmentalists have protested Tesla’s forest-clearing activities and water usage for a new factory near Berlin.

The latest lawsuit in California alleges ongoing environmental violations that expose residents and employees to excessive air Pollution, including nitrogen oxides, arsenic, and cadmium. The Bay Area Air Quality Management District has reported that Tesla has received 112 violation notices since 2019 and is seeking an order to enforce changes in Tesla’s operations to curb emissions.

Regulators indicate that frequent equipment breakdowns at the Fremont factory allow unfiltered emissions to escape into the air. Furthermore, it is alleged that Tesla employees or contractors have at times disabled air pollution controls, particularly during issues with other equipment in the paint shop—a facility with a history of repeated fires.

Tesla has not yet responded to requests for comments on the lawsuit. The company’s recent quarterly report reiterated its mission to accelerate the world’s transition to sustainable energy. However, CEO Elon Musk has been emphasizing Tesla’s advancements in artificial intelligence and self-driving technologies over electric cars and solar energy products.

As environmental concerns and legal challenges mount, the spotlight remains on Tesla’s manufacturing practices, questioning the sustainability claims of one of the world’s leading electric vehicle manufacturers.
