Polluters May Get a Free Pass as EPA Scales Back Investigations

The Environmental Protection Agency (EPA) is shifting gears—and not in a good way for people or the planet. According to a report by Hiroko Tabuchi in The New York Times, the EPA recently issued a memo announcing that it will no longer shut down energy production unless there’s an “imminent” health threat. That means ongoing investigations into some of the country’s worst polluters—like a Shell plant in Louisiana or a New Mexico refinery emitting cancer-causing benzene—could be dropped or delayed.

Even more concerning, the memo says Environmental justice is no longer a priority. Under President Biden, the EPA had targeted pollution in lower-income and minority communities, where toxic exposure is often highest. That effort is now being dialed back. Critics, including former EPA enforcement chief David Uhlmann, warn this leaves vulnerable communities “in harm’s way.”

The Trump administration’s stance is that scaling back regulations will cut costs and “unleash American energy,” but many fear it’s a green light for polluters. EPA Administrator Lee Zeldin has already proposed eliminating the agency’s science wing and slashing its budget by 65%.

Meanwhile, cases that began under Biden’s leadership—like a $35 million settlement with HF Sinclair’s refinery in New Mexico—remain in limbo. Others, like a lawsuit against Denka for releasing likely carcinogens, have been dropped altogether.

Environmental law experts like UCLA’s Ann Carlson say this is a dangerous reversal. Without consistent enforcement, polluters could operate with near impunity—putting public health and ecosystems at risk for generations.

If we care about clean air, safe water, and protecting animals and people alike, we can’t afford to be silent. Support science-based environmental protections. Avoid fossil fuels, push for climate accountability, and choose plant-based, planet-friendly living every day. Our voices—and choices—matter now more than ever.
