A federal judge in Boston has upheld the constitutionality of Massachusetts’ 2016 ballot Question 3, which addresses farm animal welfare. Judge William G. Young’s decision confirms that the state law, aimed at preventing cruelty to farm animals, does not conflict with federal regulations under the Federal Meat Inspection Act.
The 2016 law, passed by Massachusetts voters, bans the confinement of breeding pigs, egg-laying hens, and veal calves in cages so small that they cannot turn around or extend their limbs. It also prohibits the sale of products from animals kept in conditions that do not meet state standards.
Massachusetts Attorney General Andrea Campbell expressed satisfaction with the ruling, emphasizing that the decision upholds a law supported by the majority of voters. “[Monday’s] ruling is a win that upholds an Act to Prevent Cruelty to Farm Animals, a law Massachusetts voters overwhelmingly passed via ballot initiative in 2016,” Campbell stated.
The Humane Society of the United States, which championed the ballot initiative, praised the decision as a victory for democracy and animal welfare. “[Monday’s] outcome is a major victory for democracy and the 78% of Massachusetts voters who said loudly and clearly at the ballot box that they want safer and more humane products on their store shelves,” said Preyel Patel, Massachusetts state director for the organization.
The legal challenge, initiated by Triumph Foods and several other pork producers, sought to overturn the law, claiming it conflicted with federal meat inspection requirements. However, Judge Young dismissed these claims, affirming that state laws can coexist with federal regulations as long as they do not interfere with the federal framework.
