A court case in Brooklyn is challenging the way New York State law views pets, specifically dogs, and whether they should be considered more than just property. The case stems from a tragic incident in July 2023 when a driver struck and killed Duke, a 4-year-old dachshund, in Brooklyn. Surveillance footage captured Duke crossing the street with his owner’s mother before the accident occurred. Now, Duke’s owner, Trevor Deblase, and his family are seeking justice, but under current state law, pets are categorized as personal property, limiting their legal options.
Eric Subin, the family’s attorney, argues that the existing law fails to address the emotional devastation caused by the loss of a beloved pet. He points out that while dogs are often seen as family members, the law only allows claims for emotional distress if an immediate family member is seriously injured or killed in certain circumstances.
In the Kings County Supreme Court, lawyers debated whether the law should be revised to reflect the emotional value pets hold in people’s lives. While some Support this potential change, others, like Paula Schasberger, express concern about the possible consequences, such as overburdened courts and increased insurance costs.
The defense, representing the driver, is pushing for the case’s dismissal, arguing that any changes to the law should be made by the state legislature, not the courts.
Judge Aaron Maslow, presiding over the case, has set a September 30 deadline for external parties to submit their arguments, signaling that this case could pave the way for significant legal developments regarding the status of pets in New York.
