In a significant legal decision, PepsiCo has successfully dismissed a lawsuit filed by New York Attorney General Letitia James, which accused the beverage giant of contributing to plastic Pollution in Buffalo’s water supply. The New York State Supreme Court in Buffalo ruled on November 1, stating that James failed to demonstrate that PepsiCo’s single-use plastic packaging created a public nuisance.

The lawsuit alleged that PepsiCo, along with its Frito-Lay division, was responsible for 17% of the plastic waste found in and around the Buffalo River. Additionally, the Attorney General claimed that the company misled consumers about its efforts to combat plastic Pollution. However, Justice Emilio Colaiacovo criticized the case, highlighting that it was individual littering, not the actions of PepsiCo, that led to the environmental issues. He noted that holding the company liable would set a precedent contrary to established legal norms.

Justice Colaiacovo also referenced a 2003 appeals court decision, suggesting that holding corporations accountable for consumer actions could open the floodgates to numerous public nuisance lawsuits. This perspective was echoed in his remarks, emphasizing that the judicial system should avoid being overwhelmed by what he termed “predatory lawsuits.”

Despite the dismissal, Attorney General James expressed disappointment and stated that her office is reviewing its options to continue protecting communities from plastic Pollution. She reiterated the commitment to addressing plastic waste as a critical threat to both public health and the environment.

PepsiCo, headquartered in Purchase, New York, expressed satisfaction with the court’s decision. The company reaffirmed its dedication to reducing plastic use and enhancing recycling efforts. PepsiCo’s extensive brand portfolio includes well-known names such as Pepsi, Gatorade, Lay’s, Doritos, and Quaker, all of which are part of its sustainability initiatives.

This case follows a similar lawsuit filed by Los Angeles County against PepsiCo and Coca-Cola, underscoring the growing legal scrutiny on major corporations regarding their role in plastic pollution. As environmental concerns continue to rise, companies like PepsiCo are under increasing pressure to adopt more sustainable practices and reduce their environmental footprint.
