In a move that shocked environmentalists and public health advocates alike, the U.S. Senate voted 52–46 on Thursday to overturn an Environmental Protection Agency (EPA) rule aimed at limiting emissions of seven of the most dangerous air pollutants from industrial facilities. The rule, introduced under the Biden administration, was one of the strongest safeguards under the Clean Air Act — and its reversal now marks the first time in the law’s 55-year history that Congress has weakened its protections.
As reported by The Washington Post‘s Maxine Joselow, the EPA rule targeted pollutants like mercury, dioxins, and alkylated lead — all linked to cancer, neurological damage, and other serious health risks even at low levels. These regulations required facilities that breached safe emission thresholds to maintain strict Pollution controls, even if emissions later dropped.
Now, thanks to lobbying from major fossil fuel and petrochemical companies, those rules may soon be history. Sen. John Curtis (R-Utah) led the resolution under the Congressional Review Act. The House is expected to pass the measure soon, and President Trump has already indicated he will sign it into law.
Groups like Earthjustice warn that this decision could allow more than 1,800 industrial sites to release higher levels of toxins with little oversight. Jo Banner, an environmental advocate in Louisiana’s heavily polluted “Cancer Alley,” says her majority-Black community is already suffering. “Any time the wind shifts, all of this Pollution is coming over to our community,” she said. “This impacts our community first and worst.”
