A new class-action lawsuit is putting Rubbermaid under fire for allegedly misleading consumers about the safety of its popular plastic food containers. According to USA TODAY reporter Melina Khan, the suit—filed in Central California by Marija Andesilic and Passion Lowe—claims that Rubbermaid’s “microwave safe” and “freezer safe” products may release dangerous microplastics when used as directed.

The lawsuit, brought against Newell Brands (Rubbermaid’s parent company), alleges that the company failed to inform customers that heating or freezing their containers could lead to microplastics leaching into food. This risk, the plaintiffs argue, could impact health by damaging the digestive system, weakening the immune system, and increasing cancer risks. Children and families using the containers for school and work lunches are particularly at risk, the suit states.

The filing follows a similar case against Ziploc’s maker, S.C. Johnson, and is being handled by the Clarkson Law Firm. Tim Giordano of the firm stated that Rubbermaid’s false safety claims have “robbed consumers of the ability to choose a safer food-storage option.”

Microplastics—tiny plastic fragments often released from degraded or heated plastic—have been widely studied. Research published in Environmental Science & Technology confirms that microwaving plastic containers can significantly increase microplastic contamination in food. While the plastics industry disputes these findings, the health risks linked to microplastic ingestion continue to draw concern from environmental and health advocates.

This case focuses on Rubbermaid’s “TakeAlongs” range, promoted for on-the-go food storage. If successful, the lawsuit could open the door to compensation for millions of consumers nationwide.
