A Peruvian farmer’s fight to hold a major polluter accountable for the climate crisis has come to an end — but the story may not be over. Saúl Luciano Lliuya, a farmer and mountain guide from Huaraz in Peru’s Andean highlands, has lost his landmark lawsuit against German energy company RWE, one of Europe’s biggest historical carbon emitters. According to NPR, Lliuya sought roughly $18,000 — equivalent to 0.5% of the cost of building flood defences — matching RWE’s estimated share of global emissions.
Lliuya claimed RWE’s emissions had contributed to the glacial melt swelling Lake Palcacocha near his hometown, threatening tens of thousands with catastrophic flooding. But a German court ruled the probability of such a disaster was too low to establish legal liability, and barred further appeals.
While the verdict is a legal loss, it’s seen as a symbolic win by environmental advocates. The case, backed by Germanwatch, was allowed to proceed through Germany’s courts for nearly a decade — setting a precedent that polluters could be sued internationally for climate damage, even in countries where they don’t operate directly. As noted by international climate law expert Petra Minnerop, the ruling hinged on facts, not legal principles — leaving the legal door open for future climate claims.
RWE, which burned coal for over a century, now aims to be carbon neutral by 2040. But Lake Palcacocha has already swelled to 30 times its historic volume — and the risk to frontline communities like Lliuya’s isn’t going away.
