Petition: Blackey Was a Nine-Month-Old Puppy in Santa Ana. Prosecutors Say His Owner Lured Him With Food and Drove Over Him.

Blackey was nine months old, black and white, a pit bull mix. On 8 September police in Santa Ana, California were called to an address on West Park Lane, where they found him dead in the road. What they did not have yet was the footage.

When they got it, according to the Santa Ana Police Department’s account, it showed the puppy being coaxed over with food. A car then drove over him and stopped there, on top of him, for roughly fifteen seconds before moving off. The woman arrested three weeks later was not a stranger who had hit a loose dog. Prosecutors say she was his owner.

Hahn Nguyen, 75, was arrested on 1 October and charged the following day with two felony counts of animal cruelty. The Orange County District Attorney’s Office has attached a sentencing enhancement for personal use of a deadly weapon. The weapon is the car. She posted $20,000 bail and was released the same week. She has been charged, not convicted, and her arraignment is set for 2 November.

That enhancement is the detail worth sitting with, because it is rare and it cuts against the way these cases usually go. Animal cruelty charges get filed and then shrink. They are pleaded down to a misdemeanour, settled with a fine and a year of probation, and the person is free to acquire another animal by the following spring. A deadly-weapon enhancement changes the arithmetic of a plea negotiation. It signals that the office intends to treat a vehicle driven deliberately over a living animal the way it would treat any other instrument used to kill something.

Whether the office holds that line is a separate question, and it is the reason to sign now rather than after. The arraignment has not happened. Nothing has been bargained yet. Petitions that arrive after a disposition are condolence letters; this one arrives while the file is still open, which is the only point at which public attention does anything at all. The fifteen seconds are also not incidental. A car that strikes an animal and keeps going is a different event from a car that comes to rest and stays. It is the stopping that makes the footage unbearable, and it is the stopping that a jury would be asked to weigh.

The petition asks the Orange County District Attorney to prosecute both felony counts fully, to decline a plea agreement that reduces them, and to seek a permanent prohibition on owning animals as part of any sentence. The ownership ban is the part that protects an animal who is not yet in the picture. Sentences expire. Probation ends. A prohibition is the only element of a cruelty sentence that is still doing work five years later.
