US senators are currently deliberating over a controversial energy-permitting reform bill introduced by Senators Joe Manchin and John Barrasso, which has sparked significant backlash from environmental groups. Labeled a “wishlist for the fossil industry” by its critics, the bill aims to expedite the permitting process for power transmission, mining, and liquefied natural gas (LNG) export projects. Manchin, an independent from West Virginia, and Barrasso, a Republican from Wyoming, will see their proposal voted on by the Senate Energy and Natural Resources Committee, where Manchin serves as chair.

The bill’s journey into law remains uncertain amidst fierce opposition and the complexities of election-year politics. Earthjustice has criticized the bill as an egregious attempt to advance fossil fuel interests under the pretense of promoting renewable energy and enhancing transmission infrastructure. The proposed legislation, according to environmentalists, would rely on outdated climate science, overlook the need for Environmental justice assessments, and threaten public health by weakening fundamental environmental protections.
Additionally, the bill proposes significant alterations to current practices, such as reducing the time for legal challenges to energy projects from six years to just 150 days. This change, advocates argue, could undermine the influence of communities on the development of local energy projects. Appalachian Voices, an environmental group, emphasized that the bill would erode the National Environmental Policy Act, limiting public engagement in energy decisions.
Despite environmental concerns, Manchin has defended the bill as a balanced measure that would not only streamline permitting processes but also safeguard environmental and community protections. He insists that the legislation will strengthen the power grid and maintain low energy prices.
The proposed reforms also include measures that would extend opportunities for offshore oil and gas leasing and expedite the approval process for LNG export applications, countering the current pause on such approvals implemented by President Joe Biden earlier this year.
The bill has been met with a chorus of disapproval from numerous environmental organizations, including the Natural Resources Defense Council (NRDC), which described the bill as a step backward for climate, health, and justice. The NRDC, along with other advocates, is urging the Senate to reject the bill and consider alternative, more environmentally friendly energy solutions.
