In a controversial move this week, the U.S. Justice Department filed lawsuits against Michigan and Hawaii for attempting to hold fossil fuel companies accountable for climate damage. The suits, first reported by The Guardian, argue that the states’ planned legal action interferes with federal authority under the Clean Air Act and the Trump administration’s push for “energy dominance.”

Legal experts say the action is unprecedented. Instead of waiting to challenge existing lawsuits in court, the Justice Department is attempting to block them before they’re even filed. Hawaii’s planned lawsuit cites the devastating 2023 Lahaina wildfire, which officials partly blame on Climate change caused by fossil fuels. Michigan’s Attorney General Dana Nessel called the federal lawsuit “frivolous” and “arguably sanctionable,” noting that Michigan hasn’t yet filed any litigation.

The Clean Air Act does authorize the EPA to regulate emissions—but under Trump, the EPA’s current leadership is also trying to reverse a key finding that greenhouse gases threaten public health. As Ann Carlson, an environmental law professor at UCLA, put it, “The hypocrisy is pretty stunning.”

This legal aggression mirrors a broader Trump-era agenda that rolls back environmental protections in favor of fossil fuel interests. From boosting coal to weakening clean water rules, the administration has signaled loyalty to the oil and gas industry—no matter the climate cost.

In a time of rising global temperatures, wildfires, and oil spills, trying to silence states that demand accountability only puts more lives and ecosystems at risk.
