President Joe Biden has taken an assertive step towards guaranteeing access to mental health care for all. He recently announced a proposed rule to ensure that mental health benefits provided by private insurance plans align with physical health benefits.

This proposed rule is designed to reinforce the Mental Health Parity and Addiction Equity Act (MHPAEA) from 2008. The goal is to require insurance providers to update their health plans, ensuring equal access to mental and physical health benefits. This move signifies an enormous stride forward in making mental health care accessible for millions, as it should be under insurance coverage.
President Biden strongly advocated that mental health care is as crucial as physical health care. He stated, “mental health care is health care. It’s essential to people’s well-being and their ability to lead a full and productive life, to find joy, to find purpose, to take care of themselves and their loved ones.”
The new rule would demand that insurers evaluate coverage based on several criteria, such as the plan’s provider network, out-of-network coverage, and the frequency of prior authorization. These analyses will enable insurers to identify areas where they fail to meet the law’s requirements, leading to necessary improvements in mental health care access.
This rule change makes it much easier to enforce health plans that violate the standards of the rule, providing regulators with the power to take enforcement actions. It essentially puts insurers on notice to ensure they comply with mental health parity requirements.
The proposed rule also targets a loophole exempting federally provided health insurance plans from complying with the MHPAEA. This move could lead to over 200 additional health plans improving mental health care for an estimated 90,000 consumers.
Addressing the disparities between mental and physical health care was a key part of President Biden’s proposed “unity agenda.” This latest move serves as a testament to his commitment to achieving mental health parity for all Americans.
