In the United States, the fight for LGBTQ rights is an ongoing, fervent struggle, as an alarming legislative trend attempts to limit access to essential services such as gender-affirming care for trans youth. Only six states, including Delaware and Illinois, have not introduced bills restricting LGBTQ rights in the current legislative session. Restrictions being considered include bathroom bills, limitations on updating identity and gender information on records and IDs, sports bans, and bans on gender-affirming care.

According to Alex Petrovnia, the founder and president of the Trans Formations Project, around 150 anti-trans bills were introduced in state Houses across the country in 2022 alone. Many are not successful, but the ones that do pass contribute to the stigma and challenges faced by transgender individuals and their families.

These legislative actions, many of which include bans on puberty blockers and gender-affirming care, carry significant implications for the mental health and well-being of transgender youth. A 2020 study highlighted that transgender individuals denied access to puberty suppression medication were 70% more likely to experience suicidal ideation than those who received these medications. With professional medical bodies like the American Medical Association, the American Psychological Society, and the American Academy of Pediatrics endorsing gender-affirming care, the passage of these bills underscores a significant disregard for expert recommendations.

Anti-trans bills also often target sports, barring transgender children from participating in sports corresponding with their gender identity. The rationale, based on preserving girls’ sports, lacks understanding and empathy for transgender children who merely wish to engage in regular childhood activities like their peers.

Understanding Gender-Affirming Care

The essence of gender-affirming care is captured in the transformative journey that many trans individuals undertake to align their physical attributes with their identified gender. This may involve changes in clothing or hairstyle, hormone treatments, and, for some, surgeries. Support for gender-affirming care comes from respected health organizations like the American Medical Association and the American Academy of Pediatrics, indicating its established significance in healthcare.

The Political Landscape

While all major medical organizations, including the American Medical Association, American Academy of Pediatrics, and the American Psychiatric Association, Support gender-affirming care as safe and medically appropriate, it faces opposition driven by a mix of factors such as religious beliefs, concerns about potential long-term consequences, and doubts about the evaluation process preceding treatment.

Iowa introduced a prohibition on gender-reassignment procedures and prescriptions. Meanwhile, two of Florida’s State Senate committees passed Senate Bill 254, which would build upon existing gender-affirming care restrictions by barring the use of state funds for gender-affirming care, among other things.

State by State

The year 2023 has seen five states—Mississippi, Utah, South Dakota, Iowa, and Tennessee—pass bans on gender-affirming care for minors. In total, nearly 90 bills that target access to gender-affirming health care, including Florida’s, are being considered across the U.S. Proponents often portray these laws as measures protecting youth from risky medical experimentation.

Eight states have gender-affirming care bans for people under the age of 18, including recent additions like Tennessee and Iowa. They join the likes of Arkansas, which passed similar legislation two years ago. However, ongoing lawsuits have delayed the program’s rollout in Arkansas, though legislators passed a measure that would criminalize medical practitioners for providing gender-affirming care for minors in March 2023. Arizona and Alabama also passed gender-care bans in 2022, though Alabama’s law is temporarily blocked by legal challenges.

State lawmakers employ various tactics to control access to such medical treatments. In Oklahoma, Senate Bill 613 threatens doctors’, nurse practitioners’, or advanced practice nurses’ licenses if they offer gender-transition services to people under the age of 18. Senate Bill 129 further extends the restrictions, banning transgender medical care at hospitals indirectly receiving public funding.

The fight for accessible gender-affirming care remains pivotal for the well-being of transgender youth. The loss of such care, a harrowing prospect for a group already facing a high unemployment rate and a suicide rate nearly nine times that of the broader U.S. population, could exacerbate these disparities.
