A new California bill, which the Legislature unanimously approved, would make removing a condom during sexual intercourse a civil offense.  This means that while the state cannot prosecute the person who removes the condom as a criminal, the victim can bring a lawsuit seeking monetary damages.

“Stealthing” has long been a well-known term in the gay community, referring to “an HIV-positive man actively trying to infect an HIV-negative man without their knowledge or consent.”  Alexandra Brodsky, who authored a study that brought attention to stealthing beyond this community, told the New York Times that civil remedies are often more useful to victims because they help victims cover medical debt or therapy.

Research shows that 12–32% of women and 10–19% of men have experienced stealthing.  While New Zealand, Switzerland, Canada, and Germany all have laws addressing this practice, California would be the first state to pass such a law.  You can sign this petition telling other states to follow suit.
