Supreme Court Ends Youth Climate Lawsuit That Inspired a Global Movement

The U.S. Supreme Court has officially shut down a landmark climate lawsuit brought by 21 young activists who, since 2015, have fought to hold the federal government accountable for its role in Climate change. As reported by Maxine Bernstein at SeattleTimes, the high court declined to revive the case, effectively ending the nearly decade-long legal battle.

Filed in Eugene, Oregon, the suit argued that the federal government had violated the plaintiffs’ constitutional rights by supporting fossil fuel policies that threaten a livable planet. The youth-led group demanded that the government create a plan to phase out fossil fuels. While a U.S. district judge initially allowed the case to proceed, the 9th U.S. Circuit Court of Appeals ordered its dismissal in response to a request from the Biden administration.

Attorney Julia Olson of Our Children’s Trust, who led the legal effort, stated that although the case has ended, it “sparked a global youth-led movement for climate rights.” More than 60 similar lawsuits have followed across the U.S. and beyond. One such case in Montana led to a historic ruling that youth have a constitutional right to a clean and healthy environment. Another in Hawaii resulted in a settlement requiring the state to expand green infrastructure, including bike lanes and EV charging stations.

Despite the Supreme Court’s refusal to intervene, the plaintiffs say the fight isn’t over. “For almost ten years, we’ve stood up for the rights of present and future generations,” said plaintiff Miko Vergun. “We’ve never wavered.”
