Farm Sanctuary has composed a letter to President Biden and USDA Secretary Vilsack, asking them to federally protect all downed animals.  Downed animals are pigs, goats, sheep, and other farm animals that can no longer stand or walk due to intensive farming practices.  While all farm animals suffer from human exploitation, treatment of downed animals is especially cruel because workers beat, drag, and shock these animals onto the kill floor.

Currently, there are federal protections for downed cows, but there are no federal protections for other downed animals.  Passing laws to protect all downed animals is important, which is why you should join Farm Sanctuary by signing this petition.  But it is equally important to recognize that these laws will be counterproductive if written improperly.

In 2012, in a case called National Meat Association v. Harris, the Supreme Court struck down a California law that mandated humane treatment of downed animals headed for slaughter.  Why? Because the National Meat Inspection Act already regulates the treatment of downed animals and, according to the Court, stops state law from doing so any differently.  Therefore, it is not only important to urge Congress to protect downed animals, it is important to urge Congress to write these laws in such a way that states can still issue their own protections.
