The Supreme Court’s decision in Loper Bright Enterprises v. Raimondo marks a significant shift in administrative law, overturning the long-standing Chevron deference doctrine. This ruling diminishes the power of federal agencies to regulate on behalf of consumers, workers, animals, and the environment, affecting policies on food safety and water pollution, and potentially undermining protections in the meat and dairy industries.
Chevron deference, established in 1984, allowed agencies like the Environmental Protection Agency (EPA) and Food and Drug Administration (FDA) to interpret ambiguous statutes based on their expertise. The new ruling shifts interpretive authority to the courts, reducing the autonomy agencies had to respond to issues such as Climate change and public health crises.
The case arose from a dispute involving Atlantic herring fishermen who opposed a National Marine Fisheries Service (NMFS) policy requiring them to fund federal monitors on their ships. Their victory is seen as a broader win for conservative interests aiming to curtail federal regulatory powers, a goal supported by the Koch Network.
Chief Justice John Roberts’ majority opinion criticized Chevron as a confusing and inconsistently applied doctrine, advocating for judicial, rather than executive, interpretation of statutory ambiguities. Justice Elena Kagan, in her dissent, warned that this shift undermines agency expertise and concentrates too much power in the judiciary.
Environmental and animal advocacy groups have expressed concerns that this decision could weaken regulations designed to protect the environment and wildlife. The ruling could challenge existing and future regulations from agencies like the EPA and the U.S. Fish and Wildlife Service, making it harder to enforce protections against Pollution and habitat destruction.
