According to the Southern Poverty Law Center, some asylum-seekers never had a legitimate “fear interview” to adequately explain why they fled their home country and why they will be concerned for their health and safety if they are forced to return. The SPLC alleges that deportations are happening before those seeking asylum can even get a hearing before a judge, or in some cases, while their file is under review or an appeal is pending. One attorney at the SPLC described the situation as so desperate that she had “never seen anything like it before.”

According to federal law, a person who expresses fear of returning to their country legally cannot be deported until they have had an interview with an asylum officer. The law also states that asylum-seekers cannot be deported while an appeal is pending or while a case is before the Board of Immigration Appeals. If the asylum officer does not find that you have a reasonable fear of persecution or torture, you may request that an IJ review the negative reasonable fear determination. If you do not request this review, ICE may remove you from the United States, according to the ISCIS.

For asylum seekers who have traveled hundreds of miles to reach asylum in the US, this one-hour fear interview could be the difference between starting a new life with their family or deportation. Their safety and quality of life are at stake. If these allegations are true, thousands of innocent people who are attempting to migrate for health and safety reasons may be in danger. A few of the asylum-seekers in question that were allegedly not given their full interview process for asylum have already suffered violence due to political repression and police brutality in their home countries. Sign this petition to demand the Office for Civil Rights and Civil Liberties thoroughly investigate these horrific claims, and determine if ICE is illegally deporting asylum-seekers!
