In a landmark decision, an Ecuadorian court has ruled that Pollution has violated the rights of the Machángara River, which flows through Quito, the nation’s capital. This ruling is hailed as “historic” by environmental activists and sets a precedent for the protection of natural features under Ecuador’s progressive constitution.

The city government has appealed the ruling, which is grounded in a unique article of Ecuador’s constitution. This article grants natural entities like rivers their own rights, a concept that remains rare worldwide. The Machángara River, originating in the Andes mountains, has been severely impacted by urban waste and contaminants as it passes through the densely populated city of Quito, home to 2.6 million residents.

Darío Iza, a representative of the Kitu Kara group that filed the complaint, emphasized the significance of the ruling. “This is historic because the river runs right through Quito, and because of its influence, people live very close to it,” he stated. The court has mandated that the government must develop and implement a cleanup plan for the river as appeals are processed.

The pollution of the Machángara River is a significant concern, with untreated wastewater and various effluents being discharged into its waters. The Global Alliance for the Rights of Nature highlighted that the river is burdened with tons of garbage from surrounding gullies and hillsides. The river’s oxygen levels average a mere 2%, creating a hostile environment for aquatic life.

Ecuador stands out globally for its recognition of the rights of nature, enshrined in its constitution. While some regions in Latin America and North America recognize the right to a clean environment for their inhabitants, Ecuador goes a step further by acknowledging the rights of natural features themselves.
