A vegan Subway employee won a £13,000 harassment claim after her boss waived meat in front of her face and urged her to eat it. Kady Reilly reportedly raises her children vegan and takes part in peaceful activism, and fundraises for animal charities.
Reilly’s line manager Himanshu Lahar made comments about her appearance and harassed her for not eating the food that she was allergic to. When she refused to eat the meat, Lahar reportedly told her, ‘NASA should send you back to Mars,’ the panel heard.
He made numerous demeaning comments, including ‘eat like a man, walk like a bull’ and ‘go on, eat it, what could happen?’ He would wave the meat under her nose at a gas station in Bridgeton, Glasgow. Reilly is vegan but also suffers from allergies and carries an Epi-pen with her.
Daily Mail reported that the mother of two made numerous complaints about the fast food chain, one of them that Lahar would serve vegan customers dairy cheese when they ran out of plant-based alternatives.
When the owners of the franchise, RT Management Bridgeton Limited, did not listen to Reilly’s complaints, she reported them to Environmental Health. She was fired shortly after the investigation was carried out by the local council.
She was fired in October 2020 and was told that she had not passed her probationary period. That’s when she took RT Management Bridgeton Limited to the employment tribunal claiming unfair dismissal, harassment, unauthorized deductions from wages, and that she had not had uninterrupted rest breaks.
She won each of her claims and will now receive nearly £13,000 after an employment tribunal ruled that she was fired for making the protected disclosures and that Lahar’s comments to her went against the Equality Act as her veganism constitutes a philosophical belief.
